The first step for a foreigner to start a business in Nicaragua is to incorporate the company.

To do that, you would go to the “One Stop Shop.” The One Stop Shop will give you the list of all the documents you need to present, including the act of incorporating the company. There are bills that must be paid and it takes around 15 days to get all the permits required.

The One Stop Shop is a government office designed to make it easy to do business in Nicaragua. In order to get a company incorporated, you have to comply with a couple of procedures with different government institutions, including the commercial registry, tax notary and the local municipality. The One Stop Shop has representatives from each of these institutions. All you have to do is go to the One Stop Shop in order to process each of the documents required from each of the institutions.

You do, however, have to be a legal resident, which is not that difficult.

And then, it’s just a question of getting your business permits and things like that.  It’s pretty easy; certainly not as complicated as in the United States.

I’ve started businesses in Nicaragua and I’ve started businesses in the US.  There are some differences because the business I started in Nicaragua is a hotel, so I had to follow a law specifically with regard to tourism, which took a little bit longer than opening another type of business.

I don’t think it’s that difficult to open a business in Nicaragua.  I am not aware of any differences in starting a business in Nicaragua between being a Nicaraguan citizen and a foreigner.  I believe that the same laws apply to everybody.  If you’re a legal resident living in Nicaragua, you can start a business.  It’s not a problem.

The government of Nicaragua is very interested in encouraging investment in Nicaragua and has a foreign investment law to assist and protect any investor who wants to invest in Nicaragua or start a business in Nicaragua.

The important thing to know when doing business in Nicaragua is that you need to get good local advice.  This is especially true in regard to issues regarding property.  The reason is that during the years of the revolution, some property was confiscated and then was later returned to the owner, and title became confused.  Now, when people come to Nicaragua and want to do business, it is important that they get the advice of a recognized legal advisor who can do all the due diligence regarding the properties they want to buy in order to warranty that the property has no legal problems and clear title.

In all matters regarding doing business in Nicaragua, you should go through good and recognized channels.  For example, you should get in contact with the appropriate business organization, because business organizations can accompany deals and warranty that things are done properly.  Examples of business organizations that may be appropriate for a type of business are the Chamber of Commerce, the Chamber of Industry, the Chamber of Construction, etc., all depending on the field in which the investor wants to do business.  These organizations are important allies in order to warranty an investment in the country.  The reason is that these organizations have good communication and permanent dialogue with the government of Nicaragua and are set up to facilitate all issues regarding businesses and investments into the country.

And also, there is an agency here called PRONicaragua that promotes investment in Nicaragua.  The Board of PRONicaragua is comprised of members from both the public and private sector.  PRONicaragua assists investors in facilitating their investments into Nicaragua.  It is important that potential investors or business owners use the correct channels to get things done easily.
